TERMS AND CONDITIONS
Validity
These Terms and conditions govern Samms including www.samms.co.uk
performance relating to the sale and supply of goods to the
customer. Samms reserve the right to amend these terms and conditions
at any time by updating this page; and the customer is bound
by any such modifications or revisions.
Contract With Customer
The contract between Samms and the customer comes into existence
when Samms accept the customers order i.e. when payment has
been received. Samms is entitled to withdraw from contracts
in the case of obvious typographical or arithmetical inaccuracies
appearing on Samms website.
Pricing and Availability
The prices of the goods are those specified on Samms website.
The price, as displayed, is inclusive of VAT (at the standard
uk rate). There will be an additional charge for delivery. Orders
are subject to availability. In the unlikely event that the
goods are unavailable, the customer will be notified by email.
Price and availability information is subject to change without
notice.
Delivery of Goods.
Samms will deliver the goods ordered to the delivery address
supplied by the customer. Availability permitting, all orders
paid for by debit or credit card will be despatched within 7
working days. Orders paid for by cheque require 3 working days
for clearance , and are then despatched in the same way. Samms
is entitled to despatch in part. Despatch of goods constitutes
fulfilment of contract.
Samms Warranty
If the goods are not what the customer ordered, or are of incorrect
quantity, or are damaged or defective, Samms will, if the customer
returns them within 15 days, at the customers option either
give a full refund or where possible make good any shortage
or non delivery or replace any damaged or defective goods.
Return of Goods ~ 100% money back guarantee
Please always email us on returns@samms.co.uk
before returning goods. If for any reason the customer is unhappy
with their purchase from Samms, they may return it for exchange
or refund, provided Samms receives it within 14 days from the
date of its original receipt from the customer. Returned products
must be received by Samms in it's original shipped condition
and original shipped packing. The item(s) must be without damage
or use and in a suitable condition for resale. Please note that
we cannot accept returns for any confectionery or bespoke items.
All original packaging should accompany any returned item(s).
We cannot accept returns for exchange or refund if such items
have been opened from a sealed package. All items will be inspected
on their return to us. A note explaining the reason for return
should be enclosed together with your contact details. This
does not affect your statutory rights.
You or your carrier are responsible for any returned goods until
they reach us. The customer bears the cost of returning goods
for refund or exchange except in the cases of faulty, damaged,
or wrongly supplied goods. Samms request that you use a signed
for service or registered/recorded delivery mail, and retain
proof of despatch/postage.
We are unable to replace or exchange an item until the original
is returned to Samms. If you need an item in a hurry, we suggest
you place a second order for the new item and send the original
back with a covering note.
What if I change my mind?
Under the UK's Distance Selling Regulations you have a 7 day
"cooling off" period on receipt of goods when you
may return item(s) in perfect and saleable condition, in it's
original unopened packaging if you no longer require it. It
is however your responsibility to return the item(s) in perfect
and saleable condition at your own cost. We will then arrange
to refund your debit/credit card for the item(s) minus any shipping
costs as these are non refundable. Any item(s) received after
the 7 days will not be refunded, we will however happily offer
you a credit to your account with us for future purchases. Please
note that this does not include confectionery, personalised/bespoke
items such as printed ribbons, printed balloons, printed banners,
inflated balloons.]
We aim to make refunds within one week of receipt of goods
back to us though promise to make all refunds within 30 calendar
days of receipt of goods to our premises.
Please note that we will not be held liable for any interest
payment that you may incur because any refund was made outside
of your credit/debit card timescale. Please return goods to
the address on your invoice ie Samms, 7 Lucius Street, Torquay,
Devon, TQ2 5UW.
Disclaimer
Samms hereby, to the fullest extent permitted by law, disclaims
all warranties and conditions with regard to the material and
any goods and services supplied in relation to this website,
whether expressed or implied or statutory (including all implied
warranties and conditions of the merchantability and fitness
for a particular purpose). In no event that Samms be liable
for any indirect, punitive, special, incidental or consequential
damages whatsoever even if Samms has been advised of the possibility
of damages including, without limitation, damages for loss of
use, data or profits arising out of or in any way connected
with the use or performance of this website, interruptions or
delays to this website, the provision of or failing to provide
services, or for any information, material, goods and services
obtain through this website or otherwise arising out of the
use of this website, whether based on contract, tort, or otherwise
to the fullest extent permitted by law.
Governing Law and Jurisdiction
Contracts between Samms and the customer will be governed by
English Law and all disputes will be submitted to the non exclusive
jurisdiction of the English Courts.
Intellectual Property
All the information, data, text, graphics, photographs, links
or computer code published on, contained or available on this
website (the " Material") are the copyright of Samms
and/or it's suppliers. Unauthorised use of the material including
the production, storage, modification, distribution or republication
without prior written consent of Samms, or where applicable,
the respective copyright owner(s), is prohibited.
Invalidity of Terms and Conditions
If for any reason part of these Terms and Conditions is unenforceable;
the validity of the remaining Trems and Conditions will not
be affected.
Privacy Policy
Samms respects the privacy of all our customers. We do not
sell or pass your information to anyone outside the company.
If we decide to change our privacy policy, we will post those
changes on this page so that you are always aware of what information
we collect, and how we use it.
Your Personal Information
In the normal course of administering your order, we have to
record basic details about you. How else will we know where
to send your goods to!
We never have access to your credit/debit card details when
your order is placed online; they are checked and administered
by our online bankers Protx and Natwest Streamline, providing
a secure payment system. They simply send us an authorisation
for despatch.
Using your Personal Information
Samms may use the information that you provide us(name, address/email
address) to keep you informed about our products and services
but we never pass this on to a third party.
