Terms & conditions

Please read these terms and conditions carefully as they contain important information about how you can use our website.  Personal visitors are only by prior appointment.

General Terms & Conditions:  Samm’s, of 5 Coombe Lane, Torquay, Devon, TQ2 8DY, own and operate this site.  If you have any queries, comments or complaints about these terms and conditions or about our website, you can contact us at or 01803 214281.

1.       The contract between us:  Payment of the whole of the price for the goods that you order must be received by us before your order can be accepted.  Once payment has been received by us we will then confirm that your order has been accepted by sending you an email to the email address you provide in your order form.  Our acceptance of your order brings into existence a legally binding contract between us.

2.       Ownership of rights:  All rights, including copyright, in this website are owned by or licensed to Samm’s.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own non commercial personal use, is prohibited, without our prior written permission.  You may not modify, distribute or repost anything on this website for any purpose.

3.       Disclaimer:  We cannot guarantee that your use of this website, or any links accessible through it will not cause damage to your computer.  We do however try to ensure that this website is free from defects or viruses.  You are responsible for ensuring that the right equipment is available to use the website. We will not be liable to anybody for any loss or damage which may be caused to any computer equipment as a result of using this website, except in the case of negligence on our part.

4.       Accuracy of content:  The preparation of the content of this website has been done with care.  We have tried to describe fairly all goods, and to ensure that the prices quoted are correct at the time of publishing.  Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website.  Any weights, dimensions and capacities given about the goods are only approximate.

5.       Availability:  All orders are subject to acceptance and availability.  In the event that the goods that you have ordered are not available from stock, we will contact you by email or phone.  You will then have the choice of either waiting until the item(s) is available from stock or to cancel your order. 

6.        Online Ordering errors:  You can correct errors on your order up to the point on which you click on ” submit “ during the ordering process.

7.       Pricing: All prices are inclusive of VAT at the current rate and are correct at the time of entering information.  The prices payable for goods that you order are as shown on this website. Where we are unable to supply the goods ordered, we will advise you by email and offer you an alternative of similar type and price.  If there is a time limit at this price we will advise you.

8.       Payment Terms:  Where we are accepting payment by credit/debit card we will charge that account unless we are unable to deliver within 30 days of your order.  We cannot accept liability if a delivery is delayed because you have not given us the correct  payment details.  If we cannot obtain full payment for the goods from your account, then we can cancel the contract and or suspend any further deliveries to you.  This does not affect any other rights we have. If payment is being made by cheque we will not despatch goods until we have received cleared funds, we do not accept payment by cheque for orders under £20.00 excluding delivery charge.

9.       Delivery & Charges:  These charges vary according to the type/amount of goods ordered  as  detailed on our” shipping and returns” page of the website.

It is important that you supply an accurate delivery address.  Our parcels are signed for and cannot be left elsewhere.  We cannot accept liability for any loss or damage to goods once  delivered , unless this is caused by our negligence.

10.    Risk and Ownership:  Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery the time when we tried to deliver.   You will only own the goods once they have been successfully delivered and when we have received cleared payment in full.

11.    Cancellation rights: Under the Distance Selling Regulations you have the legal right to cancel your order within seven days of receipt of your goods when you may return goods in perfect and saleable condition, in its original unopened packaging if you no longer require it. You do not need to give us a reason for cancelling your contract nor will you have to pay any penalty. However, it is your responsibility to return the goods at your own cost. We will then arrange to refund your debit/credit card/cheque for the goods minus any shipping costs as these are not refundable, as soon as possible or within 30 days.  Any goods received after the seven days will not be refunded, we will however happily offer you a credit to your account with us for future purchases made within 3 months of date of return of original goods (minus shipping costs which are not refundable). Please note we do not accept the return of Confectionery, Special Orders or Bespoke items.,   Please note that we will not be held liable for any interest payment that you may incur because any refund was made outside your credit/debit card timescale.  Please return goods to the address on your invoice :  Samm’s, 5 Coombe Lane,Torquay, Devon, TQ2 8DY.

12.    Warrenty:  If the goods are not what you ordered or wrong quantity, or damaged or defective, we will if you return them within 14 days of your receipt, at your option either give a full refund or where ever possible make good any shortage, or non delivery or replace any damaged or defective goods please email or telephone 01803 214281.

13.    Return of goods:  Please always email us on before returning goods.  If for any reason you are unhappy with your purchase from Samm’s you may return it for exchange or refund, provided Samm’s receives it within 14 days from the date of it’s original receipt from you, the customer.  Returned products must be received by Samm’s in it’s original shipped condition and original shipped packing and packaging.  The items must be without damage or use and in a suitable condition for resale.  Please note we cannot except returns for any Confectionery, Special Orders or Bespoke items.  We cannot accept returns for exchange or refunds if such items have been opened from a sealed package.  All items will be inspected on their return to us.  A note explaining the reason for return should be enclosed together with your contact details including a telephone number.  This does not affect your statutory rights.  You or your carrier are responsible for any returned goods until they reach us.  The customer bears the cost of returning goods for refund or exchange except in the cases of faulty, damaged or wrongly supplied goods.  Samm’s request that you use a signed for service or registered/recorded delivery and retain proof of despatch/postage.  We are unable to replace or exchange an item until the original is returned to us.  If you need an item in a hurry, we suggest you place a second order for the new item and send the original back with a covering note.

14.    Governing Law and Jurisdiction: Contracts beween Samm’s and the customer will be governed by English Law and all disputes will be submitted to the non exclusive jurisdiction of the English courts.

15.    Validity: These terms and conditions govern Samm’s including performance relating to the sale and supply of goods to the customer.  Samm’s reserve the right to change these terms and conditions at any time and suggest you look through them as often as possible.

16.    Privacy: You acknowledge and agree to be bound by the terms  of our privacy policy.
